Governmental Affairs and The Idaho Legislature
Impacts on Engineers
July 1st marks date that new Idaho laws are implemented; fortunately, House Bill
8 is not on that list this year. Here’s the story. During the last session of
the Idaho State Legislature, a bill was introduced that redefined the practice
of Landscape Architecture.
The American Council Of Engineering Companies (formally Consulting Engineers of
Idaho (CEI)) was notified by their lobbyist and quickly reviewed the legislation
identifying numerous issues impacting the civil engineering community. Problems
included overly broad definitions of services such as storm drainage systems and
related management plans, including vehicular circulation systems. The
definition also included, “The collaboration in the planning and design of
transportation systems, roads, bridges and structures with respect to the
functional and aesthetic requirements of the land areas on which they are to be
placed.” Such definitions were quite murky and full of potential conflict for
design responsibilities and do nothing to further safeguard life, health and
property– a charge that Civil Engineers and Landscape Architects both adhere to.
ACEC attempted to work with the bill supporters to achieve compromise
legislation. However, in the end, satisfactory language was not mutually agreed
upon and the original bill stalled in committee – due in large part to the
objectionable portions identified by ACEC. Without their efforts this bill would
probably be law today.
ACEC incurred large financial costs working to track, review and ultimately stop
this legislation. Accordingly, their legislative affairs budget has been
impacted. ISPE supports ACEC’s efforts and is encouraging ISPE members to make
donations to ACEC’s Legislative Affairs Fund to help support their lobbying
efforts. Please cut out the card below and send it in with your donation.
While your contributions will help recover costs associated with lobbying the
2003 legislature, ISPE needs to be proactive on this issue. We would rather work
together with the Landscape Architects to resolve this issue prior to the
legislative session. ISPE is looking for members who could serve on a group to
work with ACEC, ASCE, the Landscape Architects and others to help ensure any
future legislation is acceptable to all design professionals. Please contact
